HYUNDAI SONATA CLASS-ACTION LAWSUIT WILL BE APPROVED

Judge to approve Hyundai Sonata class-action lawsuit settlement terms to fix Theta II engines.

 — A Hyundai Sonata class-action lawsuit will receive final approval after U.S. District Judge Beth Labson Freeman said she sees no problem with the settlement terms and believes the agreement is excellent for Sonata owners.
The Hyundai Sonata class-action lawsuit was filed by Elizabeth Mendoza, who purchased a 2011 Hyundai Sonata in 2012 and by October 2014, she started hearing a loud knocking noise coming from the engine.
A dealer told Mendoza the Sonata had a blown piston and the repairs wouldn't be covered under warranty, leaving her holding the bill of $4,500. The plaintiff says she finally had the Theta II engine replaced by an independent mechanic for $3,000.
The class-action lawsuit alleges Hyundai knew the engines were failing due to metal debris in the oil damaging the connecting rod bearings but refused to acknowledge the defects. The plaintiff claims a big reason the automaker ignores the problems is because the engines typically fail after the warranties expire, leaving owners with the repair costs.
Mentioned in the Sonata class-action lawsuit is a 2015 recall Hyundai ordered for 2011-2012 Sonata cars to repair engines problems that could cause engine fires and failures.
The recall included Sonatas with 2-liter and 2.4-liter engines that were affected by metal debris ruining the connecting rods. Hyundai said the engine crankshaft is cleaned to remove metallic debris, but if the debris is not completely removed from the crankshaft's oil passages, it can be forced into the connecting rod oiling passages and restrict oil flow to the bearings.
Those bearings are cooled by oil flow and a reduction in the flow of oil may raise bearing temperatures, increasing the potential of premature bearing wear.
A worn connecting rod bearing will make a metallic knocking noise from the engine which increases as the engine rpm increases and may also result in illumination of the oil pressure light, letting Sonata owners know there are problems somewhere. The end result will be an engine catching on fire or stalling on the road.
The 2011 Hyundai Sonata was the first Hyundai vehicle to use an engine manufactured in Hyundai's Alabama engine factory. Hyundai first used a mechanical deburring process to remove machining debris from the crankshaft but changed to a high pressure "wet blast" process to remove metallic debris.
It wasn't long before Hyundai became aware of engine-related warranty claims after owners complained about loud noises coming from the engines or about seeing the vehicle's check engine light.
The Sonata class-action lawsuit notes Hyundai initially refused to recall the cars and finally issued a recall only after pressure from the National Highway Traffic Safety Administration.
The Hyundai Sonata class-action engine lawsuit settlement will help owners in a few ways. First, the cars included in the settlement are 2011-2014 Sonatas equipped with 2-liter or 2.4-liter Theta II engines. Second, Hyundai will pay the costs for repairs or replacements of the Theta II engines and reimburse owners for rental cars and towing expenses.
Hyundai is also expanding the warranties on the cars from 5 years/60,000 miles to 10 years/120,000 miles, and if the Sonata has more than 120,000 miles on it, Hyundai will give owners 90 days to get the cars to dealerships for repairs.
Hyundai says it has already spent more than $8.5 million fixing cars as part of the class-action settlement and expects to pay much more by the end.
Not everyone is happy with the settlement terms as more than 200 Sonata owners opted out of the agreement so far, leaving those owners the right to proceed with their own legal options.
The Hyundai Sonata class-action lawsuit was filed in the U.S. District Court for the Northern District of California -Mendoza v. Hyundai Motor Co. Ltd., et al.
The plaintiffs are represented by the Gibbs Law Group LLP, and McCuneWright LLP.

CarComplaints: TOYOTA PRIUS HEADLIGHT LAWSUIT TARGETS LOW-BEAM FAILURES

Owners say Toyota Prius low-beam headlights burn out and melt assemblies and housings.

 — A Toyota Prius headlight lawsuit alleges low-beam headlights fail at alarming rates, leaving owners to pay for repeated headlight repairs and replacements.
The proposed class-action lawsuit says 2010-2011 Prius cars should have been recalled long ago after owners kept complaining about spending a fortune to replace burned out low-beam headlights.
Plaintiff Michael Robey says he purchased a new 2010 Toyota Prius in December 2010 and by 2014 Mr. Robey noticed that his driver’s side headlight was not functioning properly, so he took the car to a dealership.
The plaintiff was told both the driver’s side and passenger’s side low-beam headlights were burned out and the driver’s side headlight assembly was melted. The dealer replaced both bulbs and the driver’s side headlight assembly for $720.08.
Based on warranty claims, consumer complaints and input from its dealerships, Toyota has allegedly known about the low-beam headlight problems since at least 2010 but ignored the defects to keep selling the cars.
The plaintiff says the cost to Prius owners is great, a common theme witnessed in customer complaints found across the Internet.
"Headlights started getting dim. Replaced bulbs with new hid bulbs. Headlights still dim. Dealer claims water is in both headlights. Requires me to replace both headlight assemblies for $1,000. Not covered under warranty. As an engineer I claim poor design." - 2010 Toyota Prius owner / San Anselmo, California
Other owners say they've been stuck with repeated repairs to keep replacing the low-beam headlights after they kept failing without warning.
"Low beam headlamps continually fail. I've had to replace lights no less that 8 times since 2012! not only an expense, but poses a significant hazard. The car can be parked, or active. There is no warning or specific mileage. Seems random." - 2010 Toyota Prius owner / Peyton, Colorado
Owners say the headlights fail without warning and leave drivers in the dark while traveling at highway speeds, creating a safety hazard to all on the road. In addition, many owners also complain about the danger resulting from melted headlight assemblies and housings.
According to the lawsuit, Toyota has refused to recall the cars or offered customers free repairs or replacements of the headlights and related parts. Toyota has also allegedly never offered to reimburse Prius owners who have paid their own money to continually replace low-beam headlights.
The Prius headlight lawsuit alleges Toyota knew of and concealed the defects from consumers at the time of sale and thereafter, causing consumers to purchase cars worth less than what was paid.
The Toyota Prius headlight lawsuit was filed in the U.S. District Court, Northern District of California, San Francisco Division - Michael Robey, et al, v. Toyota Motor Sales USA Inc.
The plaintiff is represented by Glancy Prongay & Murray LLP.

Toyota recalls nearly 960k Prius, Tacoma, RAV4, and Lexus RX 350 vehicles
Feb 12, 2014

Shane McGlaun

Toyota has announced that it is recalling a huge number of vehicles in a voluntary recall. Toyota says that it has advised the National Highway Traffic Safety Administration that it is issuing a recall of a number of its vehicles sold under the Toyota and Lexus brands.

The recall covers 700,000 Prius hybrids. The Prius cars covered in the recall are from model years 2010-2014. Toyota says that in the Prius cars the recall will allow it to update the motor/generator control ECU and hybrid control ECU software.

The problem in affected Prius cars is that the current software settings could result in higher thermal stress in certain transistors that could lead to damage. If the damage occurs, Toyota says that warning lights will illuminate and the vehicle could enter failsafe mode. Toyota also says that in rare instances the issue could result in the loss of power.

Toyota will also be updating the skid control ECU software on certain 2012 RAV4, 2012-2013 Toyota Tacoma trucks, and 2012-2013 Lexus RX 350s. The update will address an electronic circuit condition that can cause the stability control, ABS, and traction control functions in the vehicles to intermittently turn off. Toyota says that it has received no reports of accidents or injury associated with any of these issues.
