Ford Acceleration Class Action Lawsuits May Be Joined

In at least 14 states, drivers of Ford vehicles have joined Ford acceleration lawsuits. These Ford acceleration lawsuits allege that something is dangerously wrong with their Ford vehicles.

According to allegations made in Ford acceleration lawsuits, some Ford vehicles suddenly accelerate without any way of slowing them down. If true, this alleged Ford acceleration problem could be extremely dangerous, as it could cause a car to barrel through traffic with little control.

Two Ford acceleration class action lawsuits have been filed. Both were filed in a West Virginia district court.

A motion has been filed to combine the two Ford class action lawsuits on the ground that the cases are very similar, making them ideal for inclusion in a single Ford acceleration lawsuit.

Allegations in Ford acceleration lawsuits hold that a variety of vehicles manufactured by Ford — some sold under other brand names like Mercury — may have whatever defect is causing the Ford sudden unintended acceleration. This includes Ford cars in the 2002 to 2010 model years, including the Ford Taurus, the Ford Thunderbird, the Lincoln Town Car, the Mercury Mountaineer, and others.

In a class action lawsuit, a group of plaintiffs that have all suffered similar alleged harm at the hands of the same defendant band together and file as a group. This helps streamline the legal process by consolidating the cases into a single Ford acceleration lawsuit.

Additionally, plaintiffs can share legal fees, making it more economical. At the same time, the defendants only face a single lawsuit, so they do not have to spend the resources to engage in multiple lawsuits. Under some situations, individual cases can be merged into a class action suit after they have been filed.

The Ford acceleration lawsuits allege that plaintiffs would not have purchased a Ford vehicle if they were aware of the risk of sudden unintended acceleration. Other allegations in the Ford acceleration lawsuits include assertions that Ford advertises its vehicles as safe and reliable, despite the possibility of sudden unintended acceleration, and that the vehicles have inadequate safeguards to prevent sudden unintended acceleration.

The Ford Acceleration Lawsuit is Case No. 12-cv-06529, in the U.S. District Court for the Southern District of West Virginia (Huntington).

In general, Ford sudden acceleration lawsuits are filed individually by each plaintiff and are not class actions.

MIAMI (WSVN) -- New video has been released showing an awful scene where a car plowed into a group of people eating outside a Miami restaurant, Saturday.

Ten people were taken to the hospital after, police said, the driver struck eight diners when he lost control of his car.

Surveillance video shows the car crashing into diners outside La Pizzeria di Lemoni on Northeast Second Avenue and 46th Street, Saturday afternoon at around 4 p.m. According to City of Miami Police, 66-year-old Belony Alterma lost control of his 2003 Toyota Camry and struck the patrons sitting at tables alongside the sidewalk, including two children. "I just heard a loud boom and a lot of ruckus, and I turn around, and I see that this car went through where all these people were sitting out in the patio," said witness Joshua Arteaga. "It looked like a bomb went off."

Witnesses said the aftermath looked like something out of a horror movie. "And everyone was on the floor, and there were some kids screaming," said Sarah Raw, who works at a store located near the cafe. "There were a couple of people who were completely face down. From here, you can just see, like the chairs flew up and hit our window."

"They were people just sitting down and enjoying a meal with their families," said Miami Police spokesperson Kenia Fallat.

Before he crashed into the pedestrians, police said, Alterma struck a light pole. "That very light pole may have saved all these people's lives," said Fallat. "It appears that that light pole is the one that took the severe impact, and that is what caused the man to lose control and plow into those patrons sitting outside that restaurant."

One witness then saw the driver's terrified wife in the front seat. "His wife was very ecstatic," said Joseph Gougre. "She was just very upset about the whole thing."

The more severely injured victims were rushed to Jackson Memorial Hospital's Ryder Trauma Center. The rest were transported to Mount Sinai Medical Center and JMH's emergency room. Officials said the children only suffered minor injuries, but one person was transported in critical condition.

Alterma remained on the scene. He said his wife and niece were riding in the vehicle with him. The niece was OK, but his wife was transported to JMH with a mouth injury.

Speaking in Creole at his home, Alterma told 7News he is still shaken up and feels bad about the accident. "He said he was driving and pressed the brakes of the vehicle, and it just shifted, and [he] lost control," said Alterma's neighbor, who translated for him.

"It really hurts him what happened, and he's really sad and sorry for the incident that occurred today," Alterma's neighbor continued.

Saturday afternoon, restaurant employees cleaned up the debris from the accident. They declined to comment.

Police continue investigating. They believe speed may have been a factor in the crash.

Toyota, GM and now VW…An industry prone to mega crises?

In 2014, Toyota sold 10.24 million vehicles, beating VW’s 10.14 million and GM’s 9.92 million vehicles. In total, the three OEMs sold 30.3 million vehicles across 24 car and truck brands globally, including the heavy commercial vehicles sold by Toyota and VW. Although these three OEMs consistently make up the top three list of global OEMs by volume sales, it is Volkswagen which in H1 2015 appeared to have gained the lead, outselling Toyota by 20,000 units.

Since 2009, however, each of these three OEMs has also found itself embroiled in a major scandal involving wrongdoing, cover-ups and breaches of trust. Each scandal had worldwide implications, and looked capable of having disastrous long-term effects on the company concerned. Toyota was hit by the sudden unintended acceleration scandal in 2009; General Motors spent 2014 tackling the ignition switch fiasco; in 2015, the industry has been rocked by allegations that Volkswagen has fudged diesel emissions results.

Each case has been markedly different, not only in the alleged offences, but also in the way they have been handled by the authorities, the companies’ internal response, and the associated public reaction.

Woman drives into Lake County church during food drive, hurting 5 people

Five people were taken to a hospital Saturday after a woman crashed through the front doors of a church near Grayslake and hit several people who were there for a food drive, pinning one of them, police said.

The 72-year-old woman had been in the parking lot of the Wildwood Presbyterian Church, 18630 West Old Gages Lake Road outside Grayslake, when the crash took place about 8:30 a.m. All those injured suffered non-life-threatening injuries and were taken to Advocate Condell Medical Center, according to a release from the Lake County sheriff’s office.

A food drive was going on at the church, with “numerous” people standing in line outside the church when the woman, who was in a 2002 Toyota Camry in the parking lot, drove into the church’s front doors, hitting several people, as well as tables that were set up for the food drive, police said.

The most severely injured person was someone who became pinned between the car’s front bumper and a wall inside the church, according to police. Fire crews were able to free her.

Several other people suffered minor injuries when they were hit by flying debris from the crash, but they were not taken to the hospital, police said.

The Lake County sheriff’s crash unit was investigating.

Castro Valley: Woman injured when car crashes into building

CASTRO VALLEY -- A 55-year-old woman was injured Friday morning the the car she was driving flipped and landed on its roof inside a building, a California Highway Patrol spokesman said.

The collision happened at 7:10 a.m. when the motorist was driving a four-door Toyota sedan southbound on Lake Chabot Road, Officer Dan Jacowitz said.

When she tried to turn onto Castro Valley Boulevard, she instead kept going south and sheared a light pole, hit a PG&E box, careened over a median, flipped over and crashed into an optometry office, Jacowitz said.

The car landed on its roof inside Primary Eyecare Optometrics at 2687 Castro Valley Blvd., he said.

The woman, a Hayward resident, was trapped until Alameda County firefighters used hydraulic rescue tools to get her out of the car, authorities said.

She suffered major injuries and was taken to an East Bay hospital, police said.

Witnesses said she was driving more than 60 mph in an area where the speed limit is 35, Jacowitz said.

"She was traveling so fast the light pole she sheared was thrown 80 feet into the air and it landed in the same building she crashed into," he said.

No other injuries were reported. The optometry business was closed at the time of the collision.

The intersection's traffic lights in all four directions were malfunctioning after the collision, Jacowitz said.

Alameda County Sheriff's deputies directed traffic at the scene until PG&E and county crews repaired the traffic lights shortly before 11 a.m., police said.

2013 purchased new. Strange and forceful acceleration during use of cruise control so much so that I ceased to use it. The following 2 weeks, acting odd then a sudden violent acceleration while entering my garage. Was able to brake/no accident. Data recorder found no crash so I'm stuck.
NHS refused 2 appeals to reopen this issue.

This sounds like a case of pedal confusion to me. Either that or the driver has boots on that touch both pedals. Either way, I would think the owner would be dealing with Toyota and not directly with the NHTSA. Something isn't adding up here....
