NHTSA ASKED TO INVESTIGATE FATAL KIA OPTIMA CRASH

Government asked to investigate Kia Optima crash after twin boys killed in Winchester, Tennessee.

 — The National Highway Traffic Safety Administration has been asked to investigate a crash that killed twin 7-year-old boys and an 83-year-old woman. The 11:30 a.m. New Year's Eve crash in Winchester, Tennessee, occurred when a 2008 Kia Optima traveling 90 mph slammed into the rear-end of a minivan.
The minivan was stopped at a traffic light at Highway 41 and Bypass Road when the 2008 Kia Optima, driven by Mary Jane Parks, crashed into the back of the minivan, sending the minivan into a Ford F-150 driven by Robert Evans. The damage to the minivan was so severe it was difficult to tell it was a minivan (see image).
In the minivan were Lynetta and Aaron Hill, parents of twin 7-year-old boys James and John Hill. James Hill was pronounced dead at the scene and his brother John Hill died later at Vanderbilt University Medical Center in Nashville.
The driver of the Kia Optima, Mary Parks, died the next day in hospital, but before she died Parks told authorities it felt like the gas pedal was stuck and she couldn't get it to move.
Lynetta Hill was hospitalized with numerous injuries, including a collapsed lung and numerous broken ribs. Her husband is in critical condition and Jimmie Northcutt, 75, a passenger in the Optima, is listed in stable condition.
NHTSA was asked to investigate any possible mechanical malfunction after local police said they were concerned about sticking gas pedal issues in the Kia Optima.
This is the second fatal New Year's Eve crash the government has been invited to investigate based on possible unintended acceleration events.
NHTSA has agreed to send investigators to California to investigate why a Toyota Yaris slammed into another vehicle, all without leaving any skid marks. The California crash killed five people.

TIPM Class Action Settlement Approved With Rental Car & Full Repair Reimbursment

CAS Criticizes NHTSA for Violating Safety Act & Not Knowing Chrysler Misled Agency

On August 17, 2015, a California District Court approved a landmark settlement in Velasco v. Chrysler Group LLC that obtained full reimbursement for the $1,100 to $1,200 repair cost of a TIPM-7 module and for the cost of rental - far beyond the $100 to $200 replacement cost of a fuel relay in the safety recall.  The Settlement Agreement signed by Chrysler shows the settlement agreement was reached in January 2015 and was contingent on Chrysler doing a safety recall of 2012-13 Grand Cherokees and Durangos.  The class action forced the recall.  NHTSA never opened an investigation into stalling on 2011-13 Chrysler SUVs for stalling caused by a defective TIPM-7 module despite the part going on national backorder in 2013.

The Safety Act requires NHTSA to grant or deny a defect petition in 120 days. NHTSA took 337 days to deny CAS’ Defect Petition, failed to obtain a single document from Velasco including ones that showed Chrysler began an investigation more than a year earlier than it told NHTSA, and used the 337 days to construct a strawman denial of the CAS Petition.

Toyota parts shortage delays melting dashboard repairs until May 2015; refunds start immediately

Toyota is first manufacturer to extend warranty

 
 
WEST PALM BEACH - New details emerging today in the repair and refund program Toyota and Lexus are offering drivers with melting dashboards.

The manufacturer is extending its warranty on 4.5 million cars allowing free repairs if your dashboard is melting. It's what's Consumer Watchdog Jenn Strathman has been pushing for since she first uncovered the sticky, shiny problem eight months ago.

“Florida is the sunshine state,” said Toyota driver Mike Rios.

Leading the country in sunshine, but also sticky shiny dashboards.

“It’s a safety hazard,” Rios said. Six accidents were reported to the National Highway Traffic Safety Administration, including four in Toyota / Lexus vehicles.

“It's dangerous and this is going to make a big difference for all of us,” explained Rios.

Toyota is the first manufacturer to admit there is a problem, offering free repairs on certain model year Toyota and Lexus vehicles. Click here for a list of cars included in the repair .

“I was ecstatic,” explained Rios.

“When it's been in the sun for awhile it's real nasty. You feel like you are touching this sticky sponge,” explained Lexus driver Joyce Rutherford. The foam is showing on Rutherford’s dash and door panels.

“They are going to replace the dash and the door panels and rear as well on both sides. It's quite extensive what they are going to do,” explained Rutherford.

Letters are being sent to Lexus and Toyota drivers, but don’t expect repairs to start until May 2015.
“I wish the parts shortage did not exist,” explained Earl Stewart.

Stewart of Earl Stewart Toyota replaced 100 dashboards in just the last few months.

“It's a disgrace these dashes were installed in the first place,” explained Stewart. Now that millions qualify for a free repair, Toyota is using the remaining inventory for cars in accidents.

“If the dashes were not in stock and they were in transit Toyota cancelled those orders and we had to tell the customers we can’t replace their dash until May 2015,” explained Stewart.

Leaving drivers like Rios waiting a little longer for this long awaited repair.

“I believe you did a wonderful job. It was excellent. It’s the best Christmas gift everyone can have this time of year,” explained Rios.

An early holiday present, but one you’ll have to wait 5 months to unwrap.

If you paid out of pocket for one of these new dashboards, refunds will start immediately. The letter that will be mailed will have all the details for the refund process.

A House panel is expected to press Takata Corp. for the results of recent tests that could indicate whether the Japanese supplier’s airbag inflators might pose a safety hazard outside hot, humid areas.

The House Subcommittee on Commerce, Manufacturing and Trade released a memo Monday that spelled out several unanswered questions about the defects that have triggered recalls of 10 million vehicles since 2008.

According to the Dec. 1 memo, Takata so far has tested 4,000 of the 12,000 inflators that it collected from vehicles throughout the U.S.

Of those, an estimated 1,000 to 2,000 inflators were collected from areas outside high-humidity locales such as Florida, Hawaii, Puerto Rico and the Virgin Islands.

Takata previously reported that none of the inflators collected outside the high-humidity region failed its tests. But the National Highway Traffic Safety Administration has pressured automakers to expand their regional recalls nationwide after a Ford Mustang’s airbag malfunctioned in North Carolina in August.

Hiroshi Shimizu, Takata’s senior vice president for global quality assurance, is expected to testify about the company’s inflator tests at Wednesday’s hearing.

He also is likely to be asked for more details about any changes Takata has made to the design and manufacture of its inflators.

The House subcommittee wants to know whether Takata’s replacement inflators are essentially of the same design as the defective inflators.

The memo released Monday asserts that Takata has not disclosed whether it has made any changes to the design specs or manufacturing process.

The memo adds that several automakers told staffers that “they were replacing the inflators with ‘like’ parts indicating that it was the same inflator with the same propellant presumably manufactured the same way but of a newer vintage.”

Company spokesman Alby Berman could not immediately be reached for comment.
