My Review Of Route 44 Toyota:
In April 2012, we purchased a Toyota Prius from this dealership and paid for the vehicle in full.
Big Mistake!

Within 1 month, with 600 miles on the odometer, we had 3 problems that Route 44 Toyota refused to correct.

The first problem was when the vehicle transitioned from battery to engine, there was such a significant impact, it seemed as if the vehicle had been struck in the rear.

The last 2 problems were NO BRAKES!
The BRAKE Pedal traveled to the floor and the dashboard warning light came on.
There were NO BRAKES!

I demonstrated this to the Route 44 Technician sitting in the passenger seat REPEATEDLY!
We never left the property of Route 44 Toyota.

With NO BRAKES, how could I drive the vehicle?
It was left on the property of Route 44 Toyota.

We recently discovered that when Route 44 Toyota obtained my personal information on the day I paid for the vehicle, they ILLEGALLY accessed my credit report. I did NOT apply for credit and did NOT sign a credit application.

When they finally discovered my vehicle on their property with no licenses plates on it [because I had turned them in], they again ILLEGALLY accessed my credit report.

In addition, on that same day, they ILLEGALLY accessed the credit report of a disinterested Third Party whose name is NOT on the Title of the vehicle.

[When they discovered my vehicle on their property, suit had been filed and they had been formally notified, yet failed to cease contacting me.]

In other words, they obtained credit information ILLEGALLY 3 TIMES!

Posted on the RipOff Report is another incident of them doing the same thing to another customer.

This is in violation of the Fair Credit Reporting Act - a federal law.

Posted on the NHTSA web site are 30 complaints about Toyota Prius brakes, 7 of which have caused accidents.

In December 2012, a Petition for Defect Investigation was filed with NHTSA.

The attorney representing Route 44 Toyota is known for his refusal to settle matters, even when he is aware that he will lose, so we expect to be forced to go to trial in this case, possibly in federal court since Route 44 Toyota violated federal law.

The attorney representing Toyota is much the same.

So my vehicle with NO BRAKES sits and sits.

This matter is scheduled to return to court on March 18th, this post is scheduled to be posted on March 24th.

Maybe Route 44 Toyota will make a good faith effort to correct their business practices.

Another poster accused Route 44 Toyota of posting phony reviews.

Settlement allows Edmunds to crack down on fake car dealer reviews

The car shopping website Edmunds.com says it has reached a settlement with an online reputation management company that Edmunds accused of submitting fake car dealer ratings and reviews on the site, Edmunds announced Wednesday.

Officials from Edmunds said they plan to share the court order with other popular sites, including Yelp, Google+ and Foursquare, where the same company may also have submitted fake reviews.
The settlement comes at a time when consumers increasingly seek out and rely on Internet reviews and other forms of crowd sourcing to find the best businesses.

In a lawsuit a month ago, Edmunds accused Texas-based Humankind Design Ltd. of registering nearly 2,200 fake member accounts on Edmunds' website to post positive but bogus ratings and reviews about 25 dealerships in an attempt to influence consumers' opinions. That was a breach of the membership agreement, Edmunds argued.

Edmunds is one of the top online resources for car prices, dealer reviews, dealer specials and tips. Employees hand screen every review, which is how the alleged fraud was discovered. Stephanie Mar, speaking for Edmunds, said Edmunds can "confidently link" 76 unpublished reviews back to Humankind.

"This is undoubtedly a victory not just for the millions of online users who rely on dealership reviews and ratings from fellow car shoppers, but also for the thousands of honest dealers who embrace authentic customer feedback," Edmunds.com President and Chief Operating Officer Seth Berkowitz said in a statement Wednesday. "We will continue to hand screen every review submitted to our site, and we will not hesitate to push back against anyone who tries to compromise the terms of our user agreements."

Asked for comment, Humankind owner Justin Anderson said in an email Wednesday, "We have not reached a final settlement, so I'm not willing to comment at this time."

In the news release, Edmunds said it's not the only site on which Humankind has been prepared to post fake reviews.

"Humankind's own marketing materials had previously identified 15 review sites on which it was prepared to post reviews similar to those Edmunds.com alleged were fraudulent," Edmunds said in the release.

In a July news release, Edmunds said Humankind's proprietor expressly promoted that he can create fraudulent reviews on ratings websites and knew it may be against those websites' policies.

"Does posting reviews ...violate terms of service...? In general, the review sites state that you must be posting for yourself and not for someone else. So in these cases the answer would be yes," the news release quotes the proprietor as saying.

On its website, Humankind advises businesses to counter negative opinions but stops short of telling people to post positive reviews instead.

"Whenever you notice that someone posted a bad review with lower ratings, you have to contact them and try to convince them to change their opinion," the website states. "Ultimately, just posting some helpful feedback on the site where the review was posted should also improve the situation."

The site does, however, mention "profile creation" as a way to drown out negative reviews. "Both free and paid profile sites can be used to post useful information and link to various relevant sites," the company states. "By posting helpful comments in forums and engaging in discussions, the useful content provided will reflect positively on your company's online reputation."

As part of the settlement, Humankind has agreed not to register users on Edmunds' site, submit reviews or participate in online discussions on the site. Humankind also agreed to provide Edmunds with information on every account Humankind registered and reviews they submitted. Humankind will also pay an undisclosed sum toward Edmunds' legal fees.

The integrity of online reviews is important because of the increasing number of consumers who rely on such reviews to decide where to spend their money.

In a Bright Local survey of consumers this year, 85% said they read online reviews for local businesses either regularly or occasionally in the past year to determine whether it's a good business.

Seventy-three percent said positive customer reviews make them trust a business more, and 65% said they were more likely to use a business that has positive reviews online.

In May, the Eater blog wrote about a business owner soliciting people on Craigslist to post fake Yelp reviews about it. In response, Yelp wrote on its official blog that its employees respond to such ads to identify who's behind the fake posts and that employees posts a consumer alert on the business' listing if there's evidence of fake reviews.

"We caught someone red-handed trying to buy reviews for this business," the alert typically states.

"We weren't fooled but wanted you to know because buying reviews not only hurts consumers, but also honest businesses who play by the rules."

Yelp also uses automated software to employ a "review filter" that examines every review and moves about 20% of the more than 39 million reviews onto a "filtered reviews" page.

"The integrity of Yelp's content is critical to its usefulness," the blog said. "Our ability to help over 100 million people a month connect with great local businesses is achieved by a combination of technological approaches (automated filtering software) and proactive sleuthing designed to smoke out the few bad actors."

My Review Of Route 44 Toyota:
I went to purchase a new car and Sean told me their "best" offer. I returned later in the afternoon with my wife and 1 week old daughter. At the time, Sean was with another customer and took them on a test drive of the exact car that I had returned to purchase. We spoke with one of the sales managers and said we could not afford their "best" price. They came down another $1,000 and w said that we were still too far away and since they couldn't work on a better price we shook hands and decided to leave. We contacted another Toyota dealership immediately after and got the exact same car for less than the price that we offered, without negotiation. That same night, Sean texted me a very unprofessional message at 8:17PM and insulted me for wasting his time, not buying their car and also called me a liar. We will never return to Route 44 Toyota and will ensure our friends and family do the same.

There sales people suck too.

BOCH TOYOTA....WHAT A DISAPPOINTMENT!

POSTED IN dealerrater:

I had my PRIUS delivered to BOCH to run diagnostics .
In a subsequent conversation, I was told that diagnostics
could not be run. When I picked up my vehicle, I was informed that diagnostics had, in fact been run, paid $125 for them.

When I requested a copy, they were denied to me.

In addition, without my knowledge or permission, my vehicle was
ROAD TESTED after having sat for 6 years and without at least
having the oil changed or fluids checked.

I was so shocked, I was unable to respond to the fact that you
may have potentially damaged the vehicle.

When an astute AAA driver went to jump the battery, he realized that the GROUND TERMINAL CONNECTION was loose.

Brian at Topham's in Middleboro  changed the oil, replaced the battery and the BRAKES now function as they should. The BRAKE PEDAL is high, the HILL HOLD feature works as it should.

In other words, the vehicle was delivered from the factory with a loose battery ground connection that explains the quirky behavior in endured and NO ONE AT TOYOTA stepped forward to correct such a minor fix. .

#1 Let's not forget what this is about....

This isn't just about a LEMON!

1. This is about a dealership that employed misleading tactics to obtain my social security number in order to request my credit report - not once, but TWICE!

The 2nd time was ~ 6 MONTHS AFTER I purchased and paid for the BRAND NEW LEMON.

Route 44 Toyota: Where Arrogance and Disregard of the Law Prevails

I was scammed because I didn't know the law. Please, please, don't allow yourself to be put in that position!

These are the legal reasons a credit report may be requested, none of which apply to Route 44 Toyota [bore yourself if you're so inclined]:

Route 44 Toyota and FCRA [Fair Credit Reporting Act]

In addition to requesting MY credit report ~ 6 months AFTER the LEMON was purchased, they requested the credit report of a friend - unrelated to the car - his name is NOT on the title.

I wrote numerous letters and filed complaints in an attempt to remove the inquiries.

The credit inquiries were Faxed immediately upon discovery to the Arrogant Dilly, Dally Dan Viera, who ignored the issue until it was posted on dealerrater.

A Temper Tantrum was thrown!

When the truthful and accurate information was posted on dealerrater, Dilly, Dally Dan BULLIED me with threats of a SLAPP Suit [Strategic Lawsuit Against Public Participation].

At a time of heightened awareness about BULLYING, Attorney Dan Viera and his client, Route 44 Toyota are woefully out of touch. BULLYING is not different regardless of the target.

Folks, know your rights when you deal with BULLIES!

Explained here:

Route 44 Toyota Threatens SLAPP

  • The Costs of SLAPP Suits

  • SLAPP and the First Amendment

...classic SLAPP suit. The point of it was to shut Alexandria up and to shut up the commenters. I think you’ve touched on the fact that this was a—the people involved in this enjoy a position of privilege in the community, and they are not used to having their misdeeds laid bare.

This would have been easily resolved were it not for ARROGANCE!

Route 44 Toyota could have acknowledged their ILLEGAL error and removed the inquiries.

    That's the problem with ARROGANCE.

Is this the kind of business you want in your life?

    I'm sorry they're in mine.

Atty. Dan Viera's Failures, Terrence Gandy's Big Mouth and Route 44 Toyota's Continuing Failures!

A competent attorney seeking to protect his client's interests would clearly instruct his client to cease ALL communications while a lawsuit is pending.

Instead, the LEMON LADY has endured BULLYING ......

    ...temper tantrums...

...a gaggle of attorneys...more attorneys than O.J. Simpson and Whitey Bulger combined...

...objections to her First Amendment rights...

...and threats of a SLAPP Suit.....

ROUTE 44 TOYOTA continued to harrass the LEMON LADY AFTER notified of a lawsuit.....

    ...flooding her mailbox....

....Attorney Dan Viera, representing ROUTE 44 TOYOTA from the beginning failed to clearly explain appropriate conduct to his client....apparently....

The ROUTE 44 TOYOTA salesman who sold the LEMON LADY the TOYOTA LEMON initiated communication on facebook....

Since the Gaggle scrutinizes the LEMON LADY's public comments, wouldn't you think they could do their jobs?

This is some of the facebook exchange:

Terrence, This is what you posted on your facebook page:

    Terrence Gandy

    Yesterday near East Taunton, MA.
"About to bring a car for a customer to Boston.Bringing a bunch of credit apps hit me up if your interested"

Since you're such a big man, surely you are aware of the requirements under FCRA [Fair Credit Reporting Act].

That's a federal statute about which I have blogged extensively because of Route 44 Toyota and your participation.

Are you aware that it is a violation of FCRA to request a credit report unless someone is applying for credit?

My credit report was requested by Route 44 Toyota on the day I fully paid for my LEMON TOYOTA. Why?

You might want to investigate what the federal penalties are for violating FCRA. [I believe it's $3,000 for each incident, but you must know a good attorney.]

This provides some of the details:
    http://jessiepowell.blogspot.com/.../09/more-than-lemon.html

If you go to my blog, there's a search feature in the corner. Just type in FCRA:

    http://jessiepowell.blogspot.com/search?q=FCRA

Please learn to keep your mouth shut when you don't know the law!

Terrence Gandy Only serious inquiries please

    •
Route 44 Toyota Sold Me A Lemon

I recommend that you consult an attorney who represents your interests. You posted on my facebook page which was highly inappropriate!

    Terrence Gandy Serious inquiry only

  •
Terrence Gandy Only if your interested serious inquiry's only.

    • Route 44 Toyota Sold Me A Lemon A responsible attorney would instruct his client to refrain from comment when there is a lawsuit pending.

In this case, it might seem the the attorney representing ROUTE 44 TOYOTA failed to do so or his client ignored his instructions.

Since you are a party to this lawsuit, it would seem your post on my facebook page is inappropriate at best, or illegal.

Maybe you should stop digging yourself in deeper since my credit report was run twice - neither time did I request credit.

My friend's credit report was also requested twice - ROUTE 44 TOYOTA does not possess, nor did they produce a credit app containing his signature.

      Duh?

Is this your own personal SCAM or one encouraged and approved by management?

Didn't the 'Discovery' documents produce by ROUTE 44 TOYOTA indicate that you were no longer employed by them, your photo no longer appears on dealerrater.

ROUTE 44 TOYOTA indicated that Tony Roma no longer works for the dealership, yet his photo continues to appear on dealerrater.

    More Than A LEMON......

A lawsuit was filed + 1 year ago for my BRAND NEW LEMON TOYOTA.

    Civil Action #1259CV871

    Plymouth Court

This isn't solely about my BRAND NEW TOYOTA LEMON!

This is about forewarning others about what I consider a SCAM!

I've tried to KEEP THIS SIMPLE!

There's far more to ROUTE 44 TOYOTA that's not included since this has gone on endlessly.

[If you have any questions, please don't hesitate to send me a private email - comments are 'moderated' and will not be made public.]

    1.  ILLEGAL BUSINESS PRACTICE

During my annual CREDIT REPORT REVIEW, I discovered ROUTE 44 TOYOTA had ILLEGALLY accessed my CREDIT REPORT twice - on the day I fully paid for the BRAND NEW LEMON TOYOTA, and then ~ 6 months later when they discovered MY LEMON TOYOTA on their property with no license plates [because I had turned them in].

In addition, on that day, they also ILLEGALLY accessed the credit report of a friend whose name is NOT connected to the vehicle.

[Someone else has complained about this practice: The Arrogance of Route 44 Toyota]

When I attempted to get the INQUIRIES removed, their attorney offered gibberish:

I am not at liberty to discuss with you in detail why those claims are both false.

The legally permissible uses established by CONGRESS are here, clearly enumerated:

ROUTE 44 TOYOTA violated FCRA [Fair Credit Reporting Act].

When they refused to remove the ILLEGAL CREDIT INQUIRIES, I posted my experience here on dealerrater to allow them to rectify their ILLEGAL BUSINESS PRACTICE:

Reviews will automatically post after the two week reconciliation period has ended.

ROUTE 44 TOYOTA could have very simply removed the ILLEGAL CREDIT INQUIRIES and offered an excuse:

'.....new employee....unaware of company policy....no longer with the company....blah, blah, blah.'

Instead, I was threatened with a SLAPP suit [Strategic Lawsuit Against Public Participation], intended to BULLY and INTIMIDATE!  The tool of the ARROGANT and COWARDS!

    More ARROGANCE, BULLYING and SEXISM:
Route 44 Toyota: Sit in the corner and be a good girl!

    2. HARASSMENT!

When a lawsuit is initiated, ALL COMMUNICATIONS need to CEASE!

With ROUTE 44 TOYOTA, it needed to be protested REPEATEDLY!

They're like LEECHES and you can't get rid of them!

    OTHER:

Route 44 Toyota is like having LEECHES!

    3.  ROUTE 44 TOYOTA employs an arrogant and bullying attorney that should have provided appropriate legal advice making ROUTE 44 TOYOTA aware that this business practice was ILLEGAL as well:

ROUTE 44 TOYOTA posts the photos of new TOYOTA owners in front of their vehicles, sends them a cheap calendar, and posts their photos WITHOUT DISCLOSURE!

As if that isn't bad enough, in some cases, ROUTE 44 TOYOTA also posts the NAMES of NEW TOYOTA OWNERS and includes the LICENSE PLATES.

This is an invitation to CAR THIEVES and STALKERS! in addition to being ILLEGAL!

    Whose BRAIN FART was that?

    4. HERTZ

ROUTE 44 TOYOTA made arrangements for a 'loaner' from HERTZ, RAYNHAM....even though Enterprise is NEXT DOOR.

They subsequently FORGED my name on a RENTAL AGREEMENT.

Hertz, Raynham: Dilly, Dally, Delay & Billem

Hertz, Raynham: Dilly, Dally, Delay & Billem Part 2

The Dilly, Dally, Delay, Stall & Bill 'em KING!

Do you really want to do business with a business like ROUTE 44 TOYOTA?

    Bear this in mind:

"A customer that has a good experience will typically tell 3 to 5 people, but a customer who has a poor experience will tell more than 20. When this is trend occurs via the web, these numbers can rapidly multiply and could spell disaster for brands that don’t have strategies in place to combat online negative chatter."

FROM: IMPACT OF NEGATIVE CONSUMER EXPERIENCES

How many people know about the LEMON LADY?

Do you think it's only 20?

How many will it be when I began ADVERTISING?
